The Supreme Court has ordered President Muhammadu Buhari's Executive Order 10 (EO10) on the funding of the State Judiciary and Legislature to be illegal and unconstitutional.
The majority of the court's seven-member panel agreed in a divided judgment on Friday that the President exceeded his constitutional authority in issuing the EO10.
Six of the panel's seven members voted to nullify and set aside the EOp10. The majority ruling also stated that it was not the federal government's responsibility to support the superior courts established for states under Section 6 of the Constitution's capital and recurring expenses.
All seven members agreed that the states were not entitled to a reimbursement of all the money they had spent on the courts up to this point.
The decision was based on a lawsuit filed by 36 states against the FG over judicial funding and the validity of the EO10.
